Conditions of Sale

  • Title to the merchandise of this sales order does not pass from our company to purchaser until merchandise is paid in full.
  • We reserve the right to cancel this sales order at any time by notifying the purchaser in writing and returning any monies received on account against this sales order.
  • We will not be liable for delays or failure to ship due to war, strikes, floods, accidents, government demands of priorities, labor disturbances, shortages of supplies or materials or other conditions beyond our control or the manufacturer’s. Cancellation by the customer of any part of this sales contract, whether it be ordered or in-stock merchandise, will result in the forfeiture of the required 1/3 deposit. Deposit cannot be used as store credit toward another purchase. No refunds are available.
  • It is customer’s responsibility to check order for accuracy, especially with regard to style numbers, finish and fabric choices. Errors in pricing or arithmetic are subject to correction. Customer is responsible for return delivery charges if merchandise sent back is determined to have been ordered correctly.
  • Since we specialize in custom orders, we reserve the right to release all merchandise to a carrier or insist upon pick-up within seven days of its arrival in our warehouse or storage charges will accrue in the amount of $7.50 per day.
  • Shipment by van lines are sent freight collect and include in-home delivery and set up. Sales orders that are delivered or shipped must be paid in full by cash, cashiers check or ACH, once received into our warehouse. Credit Card is not accepted for balance payment. A $35.00 fee will be charged on all returned checks.
  • Shipping rates are those prevailing at time of shipment and are subject to change without notice. Shipping times cannot be guaranteed, however, Hickory Park Furniture Galleries will ship all freight on fastest available carrier unless a specified carrier is requested. It is the customer’s responsibility to turn in the consolidation form to each store participating to assure proper consolidation.
  • We are not responsible for fit and /or entry of furniture in your home. We will gladly provide you with dimensions of any or all furniture prior to purchase upon request. Delivery companies will not move existing furniture.
  • In the event of freight damage or manufacturing defects, please be aware of the following when handling a claim. All merchandise received should be inspected for damage or manufacturing defects. If any damage is present, please note the nature of the damage on all copies of the delivery documents and have the driver sign them. Retain a copy for your records. Any damaged or defective items should be refused. Damaged or defective items will be restored to manufacturer standards. Damage noticed to furniture or personal property after the driver has left, must be reported to the carrier within 24 hours. All claims after this period may be denied.
  • All new furniture may have small amounts of pumice dust, wax, glue, superficial scratches and possible packing marks from the wrapping materials or blankets. Pine knots, cherry pits, color and variations in wood grains and scarring in leather are natural characteristics and are not defects, but rather hallmarks of quality furniture. It is impossible to control the expanding and contracting of woods caused by many different humidity conditions throughout the country. Hickory Park Furniture Galleries nor the carrier are responsible for drawer swelling, door adjustments, touch up or leveling of the items.
  • Hickory Park Furniture Galleries does not guarantee the durability, wearing quality, and fastness of color of fabrics, vinyl’s, or leather products, however, they will be covered under the manufacturer’s warranty if warranty is available.
  • Clearance items are sold as is and are not covered under warranty, No refunds are available.
  • For those who elect to pick-up their merchandise, warehouse hours are 9 a.m. – 12 p.m., 1 p.m. – 4 p.m. Monday through Friday. Merchandise should be inspected at time of pick-up. Hickory Park will not be responsible for damages after pick-up. 48 hour notice is required for pick-up at warehouse.
  • Hickory Park Furniture Galleries will collect taxes in the states of AL, AZ, CA, CO, FL, GA, IA, IL, IN, KS, KY, LA, MA, ME, MD, MI, MN, MO, NC, NJ, NV, NY, OH, OK, PA, RI, SC, TN, TX, VA, WA, WV & WI If your state is not listed, we encourage you to consult state and local tax laws to determine the amount of sales or use tax liability, if any.
  • Customers are required to supply photographs of any damage or defect via e-mail or mail before claims can be processed.
  • We assess a shared surcharge on all credit card transactions that is not greater than our cost of acceptance.
  • Individual items weighing more than 350 lbs may incur additional shipping charges.
